Terms of Service

Welcome to MUBA. These Terms of Service ("Terms") govern your use of the MUBA platform, website, and mobile application operated by MUBA The Agency LLC, a Wyoming limited liability company ("MUBA", "we", "us", "our"). By creating an account or using our services, you agree to these Terms.


1. About MUBA

MUBA is a talent marketplace that connects clients ("Clients") with independent creative professionals including makeup artists, hair stylists, videographers, photographers, wardrobe specialists, and other creative talent ("Artists"). MUBA provides the platform and payment infrastructure but is not a party to the service agreements between Clients and Artists. Artists are independent contractors, not employees of MUBA.


2. Accounts

  • Eligibility: You must be at least 18 years old and legally able to enter into contracts to use MUBA.
  • Account accuracy: You agree to provide accurate, current, and complete information when creating your account.
  • Account security: You are responsible for maintaining the confidentiality of your login credentials.
  • One account per person: You may not create multiple accounts or transfer your account to another person.


3. Bookings and Payments

  • Booking confirmation: A booking is confirmed only after the Client completes payment through the MUBA platform.
  • Platform fee: MUBA charges a 5% service fee on each transaction. This fee is added to the Artist's rate and is paid by the Client at the time of booking.
  • Artist payouts: Artists receive their earnings via Stripe, MUBA's payment processor. Standard payouts are processed within 2 business days after a completed booking. Stripe's processing fees (2.9% + $0.30 per transaction) are deducted from the Artist's payout.
  • Payment processing: All payments are processed securely through Stripe. MUBA does not store credit card information.
  • Cancellations and refunds: Governed by our Refund & Cancellation Policy, available at mubatheagency.com/refund-policy.


4. Artist Responsibilities

  • Artists must provide accurate information about their skills, experience, and availability.
  • Artists must complete Stripe's identity verification to receive payouts.
  • Artists are responsible for the quality of services they provide to Clients.
  • Artists are independent contractors. MUBA is not responsible for taxes, insurance, or employment benefits for Artists.
  • Artists must comply with all applicable local, state, and federal laws in providing their services.


5. Client Responsibilities

  • Clients must provide accurate booking information and be present at the agreed time and location.
  • Clients agree to treat Artists with professionalism and respect.
  • Clients must not engage or pay Artists outside of the MUBA platform for services found through MUBA for a period of 12 months after the last MUBA booking with that Artist.


6. Prohibited Conduct

Users may not:

  • Use the platform for any illegal purpose or in violation of any law.
  • Circumvent or manipulate the MUBA fee structure.
  • Post false, misleading, or defamatory content.
  • Harass, threaten, or intimidate other users.
  • Attempt to gain unauthorized access to any part of the platform.
  • Use automated tools, bots, or scrapers on the MUBA platform.


7. Intellectual Property

The MUBA platform, including its design, logo, and content, is owned by MUBA The Agency LLC and protected by intellectual property laws. Users may not reproduce, distribute, or create derivative works from MUBA content without written permission. Artists retain ownership of their portfolio content but grant MUBA a license to display it on the platform.


8. Limitation of Liability

MUBA provides the platform "as is" and makes no warranties regarding the quality of services provided by Artists. To the maximum extent permitted by law, MUBA's liability to any user is limited to the amount of platform fees paid by that user in the 3 months preceding the claim. MUBA is not liable for indirect, incidental, or consequential damages.


9. Termination

MUBA reserves the right to suspend or terminate any account that violates these Terms, at our sole discretion and without prior notice. Users may delete their account at any time by contacting support@mubatheagency.com.


10. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Wyoming or through binding arbitration as mutually agreed.


11. Changes to These Terms

MUBA reserves the right to update these Terms at any time. We will notify users of material changes via email or a notice on the platform. Continued use of MUBA after changes constitutes acceptance of the updated Terms.
